Terms of Service

These Terms of Service ("Terms") govern your access to and use of the seottak mobile application and website located at seottak.com (collectively, the "Service"), operated by ERLIVION GLOBAL LLC ("we," "us," or "our").

By creating an account, downloading the app, or otherwise accessing the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Description of Service

seottak is a Korean language learning application designed for foreigners. The Service provides vocabulary learning, flashcard practice, quizzes, matching exercises, listening practice, writing practice (Hangul), and spaced-repetition review across proficiency levels A1 through C2. The Service includes over 1,200 Korean words organized into 54 categories.

The Service is available on iOS and Android mobile platforms. Certain features may vary between platforms and may be updated, modified, or discontinued at our discretion.

2. Acceptance of Terms

By accessing or using the Service, you represent that you are at least 13 years old (or 16 years old if you reside in the European Economic Area). If you are under the age of legal majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

We reserve the right to update or modify these Terms at any time. Material changes will be communicated through the app or by email. Your continued use of the Service after any such changes constitutes acceptance of the revised Terms.

3. User Accounts

To access certain features of the Service, you must create an account by providing a valid email address and password. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately at hello@seottak.com if you suspect unauthorized access to your account.

You may not create multiple accounts, share your account with others, or transfer your account to another person without our prior written consent. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Freemium Model and Subscriptions

4.1 Free Tier

The Service offers a free tier that allows limited daily usage (approximately 5 to 10 minutes of active learning per session) followed by a cooldown period (approximately 12 hours). Free-tier users have access to core learning features but may encounter restrictions on certain premium content or modes.

4.2 Premium Subscription

Premium subscriptions unlock unlimited learning time and access to all features. Subscriptions are managed and processed through the Apple App Store or Google Play Store via RevenueCat. By purchasing a subscription, you agree to the pricing and payment terms presented at the time of purchase.

4.3 Billing and Renewal

• Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date.
• Payment is charged to your Apple ID or Google Play account upon confirmation of purchase.
• You can manage or cancel your subscription through your device's app store settings.
• Refunds are subject to the policies of the Apple App Store or Google Play Store, as applicable.

4.4 Price Changes

We reserve the right to modify subscription pricing. Existing subscribers will be notified of price changes in advance and the new pricing will apply at the next renewal period. You may cancel your subscription before the new price takes effect.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the application.
• Interfere with, disrupt, or place an undue burden on the Service or its infrastructure.
• Use automated scripts, bots, or other means to access the Service or extract data without our express written permission.
• Circumvent or attempt to circumvent usage limits, cooldown timers, or other access controls.
• Create accounts using false or misleading information.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Upload, transmit, or distribute any content that is harmful, offensive, defamatory, or infringes on the rights of others.
• Use the Service in a manner that could damage, disable, overburden, or impair our servers or networks.

We reserve the right to investigate and take appropriate action against any user who, in our sole discretion, violates this section, including without limitation, suspending or terminating the user's account and reporting to law enforcement authorities.

6. Intellectual Property

6.1 Our Content

All content within the Service, including but not limited to text, graphics, images, illustrations, audio clips, the fox mascot character, logos, user interface design, vocabulary data, and software, is the property of ERLIVION GLOBAL LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial language learning purposes, subject to these Terms. This license does not include the right to modify, distribute, reproduce, publicly display, or create derivative works based on the Service or its content.

6.3 Trademarks

"seottak," the seottak logo, and all related names, logos, and product and service names are trademarks of ERLIVION GLOBAL LLC. You may not use these marks without our prior written permission.

6.4 Feedback

If you provide suggestions, ideas, or feedback regarding the Service, you grant us a worldwide, royalty-free, irrevocable, perpetual license to use and incorporate such feedback for any purpose without obligation or compensation to you.

7. User Content

The Service is primarily a language learning tool and does not include user-generated content features such as forums or social feeds. Any learning data you generate (quiz responses, writing practice submissions, progress data) is associated with your account and is used solely to provide and improve your learning experience. We do not publicly share your learning data with other users unless a future feature (e.g., leaderboards) is introduced, at which point updated terms will apply.

8. Third-Party Services

The Service may integrate with or contain links to third-party services, including the Apple App Store, Google Play Store, Supabase, and RevenueCat. Your use of these third-party services is governed by their respective terms and privacy policies. We are not responsible for the availability, content, or practices of any third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee that any content is accurate, complete, or current. The language learning content is provided for educational purposes and we make no representations regarding the effectiveness of the Service for achieving any particular level of language proficiency.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ERLIVION GLOBAL LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

Our total aggregate liability for all claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) one hundred United States dollars (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless ERLIVION GLOBAL LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

12.1 By You

You may terminate your account at any time by deleting your account through the app settings or by contacting us at hello@seottak.com. Upon termination, your right to use the Service will cease immediately. If you have an active subscription, cancellation of your account does not automatically cancel your subscription; please cancel your subscription through your app store settings to avoid further charges.

12.2 By Us

We may suspend or terminate your account and access to the Service at our sole discretion, without prior notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable. We may also terminate accounts that have been inactive for an extended period (12 months or more) after providing reasonable notice.

12.3 Effect of Termination

Upon termination, Sections 6 (Intellectual Property), 9 (Disclaimer of Warranties), 10 (Limitation of Liability), 11 (Indemnification), 13 (Governing Law), and 14 (Dispute Resolution) shall survive and remain in full force and effect.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in the State of Delaware for any disputes arising out of or relating to these Terms or your use of the Service.

14. Dispute Resolution

Before initiating any formal legal proceedings, you agree to first contact us at hello@seottak.com and attempt to resolve the dispute informally for a period of at least thirty (30) days. If the dispute cannot be resolved informally, either party may pursue resolution through the courts as described in Section 13.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against ERLIVION GLOBAL LLC.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ERLIVION GLOBAL LLC regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral, relating to the Service.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and notify you through the app or by email. Changes will take effect upon posting unless we specify otherwise. Your continued use of the Service after the revised Terms are posted constitutes your acceptance of the changes.
